What Are Employment Claims?

What Is Sexual Harassment?

The EEOC defines sexual harassment as unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature when:
• submission to such conduct was made either explicitly or implicitly a term or condition of an individual's employment;
• submission to or rejection of such conduct by an individual was used as the basis for employment decisions affecting such individual; or
• such conduct has the purpose or effect of unreasonably interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.
While women make the most claims of sexual harassment, men can also be the victims of sexual harassment and both types are strictly prohibited by law. Victims of sexual harassment deserve representation and may be entitled to monetary compensation.

Types of Situations That Are Grounds for Sexual Harassment Claims

Sexual harassment can take on the form of sexual bribery, the promising of benefits or sexual coercion by an employer or coworker. This occurs when a job benefit is directly tied to an employee submitting to unwelcome sexual advances. Typically, these cases are relatively easy to prove and, consequently, they are less common. More common and harder to prove are the hostile work environment cases, where a boss or co-worker creates an intimidating, hostile, or offensive environment.
